These Terms and Conditions ("Terms") govern your access to and use of the website located at https://www.pine9holsters.com (the "Site") and the purchase of products offered through the Site (the "Products").

The Site is owned and operated by Pine 9 Solutions LLC, a New Hampshire limited liability company doing business as Pine 9 Holsters ("Company," "we," "us," or "our").

This website is operated from the United States and is intended for customers located within the United States only. Pine 9 Holsters does not actively market, advertise, or direct its products or services to individuals outside of the United States. We currently sell and ship exclusively within the United States and do not offer international shipping or checkout for customers located in other countries or regions. Visitors from outside the United States may access the website for informational purposes only. By using this website, you acknowledge that our products, services, policies, and legal terms are designed to comply with United States laws and regulations.

By accessing or using the Site, creating an account, or placing an order (including at checkout where these Terms are presented by hyperlink), you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility (18+ Only)

The Site and Products are intended for individuals 18 years of age or older. By using the Site or purchasing Products, you represent and warrant that you are at least 18 years old and legally capable of entering into a binding contract. We do not knowingly enter into contracts with minors. You agree not to use the Site for any unlawful purpose or in violation of these Terms.

2. Electronic Communications

By using the Site or communicating with us electronically, you consent to receive communications from us electronically, including order confirmations, transactional emails, policy updates, and dispute communications. You agree that electronic communications satisfy any legal requirement that such communications be in writing.

3. Changes to These Terms

We may update these Terms at any time. The "Last Updated" date reflects the most recent revision. Continued use of the Site after changes become effective constitutes acceptance of the updated Terms.

4. Privacy and Cookies

Your use of the Site is governed by our Privacy Policy, Cookie Policy, Return and Refund Policy, and Shipping Policy, each available on the Site and incorporated by reference into these Terms. If there is a conflict between these Terms and the Privacy Policy, Cookie Policy, Return and Refund Policy, and Shipping Policy controls for those matters.

5. Fishing Rod Holsters — Products; Proper Use; Safety Responsibilities

The following section applies exclusively to Pine 9 Holsters fishing rod holsters and accessories available for purchase through the Site, including the JettyHawk and Ambie fishing rod holsters and related components. Custom firearm holster consultations are addressed separately in Section 6 and are not governed by this section.

Our fishing rod holsters are designed for use as a stationary fishing aid — a "third hand" — while the user is on shore or fixed structure. They are intended to hold a fishing rod securely while the angler is stationary and not actively casting or retrieving with that rod. Our fishing rod holsters are designed solely for recreational fishing use and are not intended for food-contact, medical, life-support, or safety-critical applications.

Our fishing rod holsters are not intended for: use while a fishing line is in the water and under tension; use on moving watercraft or while trolling; use in crowded spaces where clearance from others cannot be maintained; or use by young children.

You are solely responsible for selecting appropriate fishing rod holster products for your intended use, proper installation and mounting, regular inspection of all hardware components including screws, clips, snaps, fasteners, and tension components, maintaining safe clearance from others when holstering or drawing your rod, and discontinuing use immediately if any component becomes loose, worn, damaged, defective, or unsafe.

Fishing rod holsters are engineered for durability under normal intended stationary use conditions but are not designed to prevent all movement, detachment, failure, or injury under all circumstances, including misuse, use outside intended stationary applications, improper installation, modification, environmental exposure, or forces outside intended use.

6. Custom Firearm Holsters — Local and In-Person Only

Pine 9 Holsters offers custom-fitted firearm holsters on a limited, small-scale basis through in-person consultation only. This service is not available for online purchase, is not listed publicly on the Site, and is not offered to customers outside of the local Nashua, New Hampshire area.

No firearm holster transaction of any kind is processed through this website. No firearm holster orders are accepted online, by phone, or by email. All firearm holster consultations, fittings, and pickups are conducted exclusively in person at a location determined at the time of consultation. Firearm holsters are not shipped under any circumstances.

By engaging in a firearm holster consultation, you represent and warrant that you are legally permitted to possess the firearm for which the holster is being made under all applicable federal, state, and local laws. You are solely responsible for compliance with all applicable laws governing firearm possession, carry, and use. We do not provide legal advice regarding firearm laws and expressly disclaim any responsibility for your compliance obligations.

We reserve the right to refuse any firearm holster consultation or service in our sole discretion, without providing a reason, and to require reasonable verification of eligibility and compliance with applicable law before proceeding with any consultation.

7. Metal Clip and Hardware Installation Requirements — Fishing Rod Holsters

The following requirements apply exclusively to Pine 9 Holsters fishing rod holsters (JettyHawk, Ambie, and related accessories) and have no application to custom firearm holster consultations described in Section 6.

Metal clips and accompanying fastener hardware for fishing rod holsters require proper installation using a threadlocking compound as specified in the installation instructions provided with the product and on our website. Based on our testing, we recommend Loctite 638 Green High Strength Retaining Compound for maximum screw retention.

Warranty coverage, return eligibility, and replacement do not extend to metal clips, screws, nuts, or related fasteners for fishing rod holsters where loss, damage, or failure is attributable to installation without the recommended threadlocking compound or failure to follow the provided installation instructions. This exclusion applies regardless of when within the warranty period the failure occurs.

By installing hardware on a fishing rod holster, the customer acknowledges receipt of and responsibility for following the installation instructions provided on our product pages and included in written form with every hardware order.

8. Orders; Payment; Fraud Prevention; Chargebacks

Submitting an order constitutes an offer to purchase. We reserve the right to accept, refuse, limit, delay, or cancel any order in our sole discretion, including for suspected fraud, unauthorized activity, inventory limitations, pricing errors, shipping restrictions, or payment authorization issues.

By placing an order, you authorize us and our payment processors to charge your payment method for the total amount presented at checkout, including applicable taxes and shipping.

We may use automated fraud detection tools and may request additional verification. Automated systems used for fraud prevention and order management do not produce legal or similarly significant effects without human review.

To resolve chargebacks or payment disputes, we may provide relevant transaction, order, shipping, and account information to payment processors, financial institutions, and dispute-resolution providers as permitted by law and consistent with our Privacy Policy.

We do not store full credit card numbers.

9. Pricing; Taxes

Prices may change without notice. Prices may not include applicable taxes or shipping charges, which will be calculated at checkout where required by law.

10. Force Majeure

We are not liable for any delay or failure to perform our obligations under these Terms resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, fire, flood, earthquake, pandemic, epidemic, war, terrorism, civil unrest, labor disputes, supply chain disruptions, carrier delays, third-party fulfillment failures, platform or technology outages, cyber incidents, or government actions or restrictions. In such circumstances, our obligations will be suspended for the duration of the event and we will make reasonable efforts to resume performance as soon as practicable.

11. Product Use; Assumption of Risk; Injury Disclaimer — Fishing Rod Holsters

Use of Pine 9 Holsters fishing rod holsters and accessories involves inherent risks associated with outdoor recreational fishing activities, including but not limited to physical movement, contact with fishing equipment such as hooks and rods, use in varied environmental conditions, and proximity to water. You assume all responsibility for the proper selection, installation, use, inspection, and maintenance of our fishing rod holster products.

Our fishing rod holsters are designed exclusively for stationary use as described in Section 5. Use outside of the intended stationary application — including but not limited to use on moving watercraft, while trolling, while a fishing line is under tension, or in crowded spaces — is outside the intended design of our products and is undertaken entirely at your own risk.

We are not liable for injuries, property damage, or other losses resulting from misuse, use outside intended stationary applications, improper installation, failure to follow provided instructions, modification of products, failure to inspect hardware, failure to maintain safe clearance from others, or use of our products in a manner inconsistent with their intended purpose. This assumption of risk is in addition to and does not limit the Limitation of Liability set forth in Section 21.

12. Website Availability

We do not guarantee that the Site will be available at all times, uninterrupted, secure, or error-free. We reserve the right to modify, suspend, or discontinue any part of the Site at any time without notice or liability. We are not responsible for losses or damages resulting from website unavailability, technical errors, or interruptions to service caused by our platform provider or other third parties.

13. California Proposition 65

Our products may contain materials or components that are subject to California's Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65). Where applicable, Proposition 65 warnings are provided on product pages or product packaging. For more information, visit www.P65Warnings.ca.gov.

14. Export Compliance

Our products are intended for use within the United States only and are subject to applicable U.S. export control laws and regulations, including the Export Administration Regulations and, where applicable, the International Traffic in Arms Regulations. You agree not to export, re-export, or transfer our products in violation of applicable U.S. export control laws. We reserve the right to cancel any order that we reasonably believe may violate these requirements.

15. Shipping; Title; Risk of Loss; Delivery Issues — Fishing Rod Holsters

The shipping terms in this section apply exclusively to fishing rod holsters and accessories purchased through the Site. Custom firearm holsters described in Section 6 are never shipped and are not subject to this section.

We currently sell and ship fishing rod holster Products within the United States only. We do not offer international shipping.

Except as otherwise required by applicable non-waivable consumer protection laws, title and risk of loss transfer upon our delivery of the Products to the carrier. Delivery dates are estimates and not guarantees.

Some fishing rod holster orders may ship in multiple packages from separate fulfillment locations and will arrive separately with individual tracking numbers. You will not be charged additional shipping fees for split shipments.

If a shipment is lost, damaged, or materially incorrect, you must notify us within 14 days of carrier delivery confirmation, or within 14 days of the estimated delivery date if confirmation is unavailable. We may require documentation to assist with carrier claims.

We are generally not responsible for loss or theft after confirmed delivery by the carrier; however, we may in our sole discretion assist with carrier claims or provide a courtesy resolution depending on the circumstances.

Additional shipping practices and procedures are described in our Shipping Policy, which is incorporated by reference.

16. Returns, Refunds, and Limited Warranty — Fishing Rod Holsters

The return policy and limited warranty in this section apply exclusively to fishing rod holsters and accessories purchased through the Site. Custom firearm holster consultations described in Section 6 involve no online transaction and are not subject to this section. Any warranty terms applicable to custom firearm holsters are determined at the time of in-person consultation.

16.1 Return Policy

We offer a 30-day return period from the date of carrier-confirmed delivery for eligible fishing rod holster products. To be eligible for a return, all of the following conditions must be met without exception:

The item must be in its original, factory-sealed, unopened packaging. Packaging that has been opened, resealed, tampered with, or damaged in any way does not qualify. The item must be unused, uninstalled, and unmounted. All original components, hardware, accessories, and inserts must be present and unaltered. The item must show no signs of wear, use, installation, modification, or post-delivery damage. Proof of purchase is required.

The following fishing rod holster and accessory items are not eligible for return or refund under any circumstances: custom or made-to-order items; clearance or final sale items; items purchased at a discount of 25% or more off regular retail price; apparel including shirts and hats; spare parts, replacement components, and hardware accessories; metal clips, belt clip hardware, screws, nuts, and related fasteners; and any item that has been installed, mounted, modified, or used in any way.

A restocking fee of 10% of the item subtotal, excluding original shipping charges, will be deducted from all approved non-defective returns. Original shipping charges are non-refundable unless the return is due to a verified defect, shipping damage, or fulfillment error.

Returns that do not meet eligibility requirements will be rejected. Rejected items will be held for 14 days, during which you may arrange and pay for return shipment back to you. Items not claimed within 14 days may be disposed of at our discretion.

Return authorization must be obtained before shipping any item back. Unauthorized returns will be refused. Return authorization does not guarantee refund approval pending physical inspection.

We reserve the right to refuse returns from customers who abuse this policy or engage in fraudulent return activity.

If these Terms conflict with our Return and Refund Policy regarding procedures, the Return and Refund Policy controls for procedural matters.

16.2 30-Day Limited Warranty — Fishing Rod Holsters

We provide a limited warranty that fishing rod holster Products purchased through the Site will be free from defects in materials and workmanship for 30 days from the date of carrier-confirmed delivery. This warranty applies to fishing rod holsters only and does not apply to custom firearm holsters, which are addressed in Section 6.

The 30-Day Limited Warranty applies to defective fishing rod holster Products regardless of packaging condition.

If a defect covered by this limited warranty is confirmed by us after reasonable inspection within the 30-day period, we may at our discretion replace the fishing rod holster Product or issue a refund to the original payment method. These remedies constitute the sole and exclusive remedies under this limited warranty.

This limited warranty does not cover: normal wear and tear; improper installation; misuse, modification, alteration, drilling, or disassembly; failure to inspect or maintain hardware; neglect including failure to rinse products after saltwater or chemical exposure; damage caused by contact with chemicals, solvents, cleaners, sunscreens, insect repellents, or other substances not intended for use with our products; environmental exposure beyond intended use; or loss, damage, or failure of metal clips, screws, nuts, or related fasteners attributable to installation without the recommended threadlocking compound or failure to follow provided installation instructions as described in Section 7.

Our products are manufactured using high-quality materials that may vary slightly between production runs due to sourcing or availability. Any such substitutions will be functionally equivalent. We disclaim liability for adverse reactions resulting from chemical sensitivities to product materials. Individuals with known sensitivities to thermoplastics, brass, black oxide coatings, or anaerobic adhesives should review the material safety documentation available on our website before purchasing.

This limited warranty gives you specific legal rights, and you may also have other rights which vary by state. To the extent permitted by law, any implied warranties that cannot be disclaimed are limited in duration to the 30-day warranty period stated above.

17. Account Responsibility

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorized use.

18. Suspension or Termination

We reserve the right to suspend or terminate access to the Site for violations of these Terms, suspected fraud, unlawful conduct, misuse of the Site, or other conduct that we reasonably determine may harm the Company or others.

We use automated storefront access control tools to restrict access based on geographic location, IP address, VPN or proxy usage, and bot detection signals. Access may be denied automatically without prior notice to visitors determined to be outside the United States or accessing the Site through means that trigger our security controls. These automated controls are described further in our Privacy Policy.

19. No Reliance

You acknowledge that you are not relying on any statement, representation, warranty, or promise not expressly set forth in these Terms, the applicable Product description, or a written limited warranty issued by us.

20. Disclaimer of Warranties

Except as expressly provided in Section 16, the Site and Products are provided "AS IS" and "AS AVAILABLE." To the fullest extent permitted by law, and except for the limited warranty described in Section 16, we disclaim all warranties not expressly stated in these Terms. Any implied warranties that cannot be disclaimed under applicable law are limited in duration as set forth in Section 16.2.

21. Limitation of Liability

To the fullest extent permitted by applicable law, we and our affiliates, officers, employees, agents, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, business, goodwill, data, or use, arising out of or related to the Site, the Products, or these Terms.

To the fullest extent permitted by applicable law, our total liability for any claim arising out of or related to the Site, the Products, or these Terms shall not exceed the greater of: (a) the amount you paid for the Product giving rise to the claim; or (b) $100.

This limitation does not apply to liability for bodily injury or property damage to the extent prohibited by law, or to liability that cannot be limited for gross negligence or willful misconduct.

22. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless the Company and its affiliates, members, officers, employees, agents, and service providers from and against claims, liabilities, damages, losses, and expenses including reasonable attorneys' fees arising from or related to your misuse of the Site or Products, violation of these Terms, violation of applicable law, or negligence or willful misconduct, except to the extent caused by our gross negligence or willful misconduct.

23. Intellectual Property; Trademarks; Patents; Copyright; Enforcement

All content on the Site — including but not limited to text, product descriptions, photographs, videos, graphics, logos, and product designs — is owned by or licensed to Pine 9 Solutions LLC and is protected by applicable United States and international intellectual property laws, including copyright, trademark, patent, and trade dress laws.

Trademarks. The Pine 9 logo and brand mark is a registered trademark of Pine 9 Solutions LLC, U.S. Trademark Registration No. 6,870,015, registered on the Principal Register of the United States Patent and Trademark Office in International Class 28, covering fishing harnesses, fishing pole holders worn on the body, fishing rod cases, and fishing rod holders. JETTYHAWK is a trademark of Pine 9 Solutions LLC for which a trademark application has been filed with the USPTO (Serial No. 99380346) and published for opposition. All other product names, logos, slogans, and brand identifiers associated with Pine 9 Holsters are trademarks or trade dress of Pine 9 Solutions LLC, whether or not registered. Unauthorized use of our trademarks — including use in connection with competing products, counterfeit goods, misleading advertising, or any other commercial purpose without prior written authorization — is strictly prohibited and will be actively pursued.

Patents. Pine 9 Solutions LLC holds and has applied for the following United States patents covering our products and designs: U.S. Utility Patent No. 12,329,141 B1, titled "Modular Fishing Rod Holster," issued June 17, 2025, covering the modular design and reversible wear mechanism of our fishing rod holster products; U.S. Design Patent No. D1,057,414 S, titled "Holster for Fishing Reel," issued January 14, 2025, covering the ornamental design of a fishing rod holster; and a design patent application pending before the USPTO titled "Holster for Handheld Implements," covering the ornamental design of the JettyHawk fishing rod holster. Unauthorized manufacture, use, sale, or importation of products that infringe these patents or that are substantially similar to designs covered by our patent applications is a violation of federal law. We actively monitor for and pursue all available legal remedies against patent infringers, including injunctive relief and damages.

Copyright. All photographs, videos, product images, marketing materials, and written content appearing on this Site or in our marketing channels are original works protected by U.S. copyright law. Unauthorized reproduction, distribution, public display, modification, or commercial use of our copyrighted materials without prior written consent is prohibited. We actively monitor for unauthorized use of our content and will pursue all available legal remedies against infringers.

Counterfeiting. Pine 9 Solutions LLC actively monitors for counterfeit, unauthorized, or infringing products. The sale, distribution, or promotion of counterfeit Pine 9 Holsters products or products falsely bearing our trademarks, or products that infringe our patents or patent applications, is a violation of federal and state law. We actively investigate and pursue all available civil and criminal remedies against counterfeiters and infringers, including but not limited to injunctive relief, statutory damages, and referral to law enforcement where appropriate. A guide to identifying counterfeit Pine 9 Holsters products is available on our website.

Reporting Infringement. If you become aware of any unauthorized use of our trademarks, patented designs, copyrighted materials, or counterfeit products, please report it to legal@pine9holsters.com. We take all reports seriously and investigate promptly.

Limited License. Nothing on this Site grants any license or right to use our trademarks, trade dress, patented designs, copyrighted materials, or other intellectual property without prior written consent from Pine 9 Solutions LLC.

24. User Submissions

If you submit reviews, testimonials, photos, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute such content for business purposes. You represent that you have the rights necessary to grant this license. We may remove user submissions at any time in our sole discretion.

25. Third-Party Platforms and Service Providers

The Site is hosted on Shopify. We use third-party service providers for payment processing, order fulfillment, warehousing, shipping, fraud detection, analytics, and other operational functions, including American Warehouse Inc., Extensiv, and Pirate Ship. Purchases made through Amazon are governed by Amazon's terms and policies. Your use of third-party services in connection with our Site is subject to those providers' own terms and policies.

26. Dispute Resolution; Arbitration; Class Action Waiver

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement. This arbitration agreement survives termination of these Terms and your use of the Site.

Before initiating arbitration, a party must send a written Dispute Notice describing the dispute and requested relief to legal@pine9holsters.com (Subject: "Dispute Notice") and by mail to Pine 9 Solutions LLC d/b/a Pine 9 Holsters, 20 Trafalgar Square, Suite 455, Nashua, NH 03063, United States. The parties agree to attempt good faith resolution for 30 days.

Either party may bring an individual action in small claims court if the dispute qualifies and remains there.

If unresolved, any dispute arising out of or relating to the Site, the Products, or these Terms shall be resolved by binding arbitration administered by JAMS under its Consumer Arbitration Rules and Consumer Minimum Standards. Arbitration fees and costs shall be allocated in accordance with applicable JAMS Consumer Minimum Standards and governing law.

BY AGREEING TO ARBITRATION, YOU AND WE WAIVE THE RIGHT TO A TRIAL BY JURY.

All disputes must be brought individually. No class, collective, consolidated, or representative proceedings are permitted. The arbitrator may not award class-wide relief.

If the Class Action Waiver is found unenforceable as to a particular dispute, the arbitration agreement shall be void as to that dispute only.

27. Governing Law

These Terms are governed by the laws of the State of New Hampshire, without regard to conflict-of-law principles, except where non-waivable consumer protection laws apply.

28. Severability

If any provision is held unlawful or unenforceable, the remaining provisions remain in effect.

29. No Waiver

Failure to enforce any provision does not constitute a waiver.

30. Assignment

You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, restructuring, or sale of assets.

31. Notices; Contact

Legal notices to us may be sent to legal@pine9holsters.com and by mail to Pine 9 Solutions LLC d/b/a Pine 9 Holsters, 20 Trafalgar Square, Suite 455, Nashua, NH 03063, United States. We may send notices to you electronically using the contact information associated with your order or account.

32. Entire Agreement; Survival

These Terms, together with the Privacy Policy, Cookie Policy, Return and Refund Policy, and Shipping Policy, constitute the entire agreement between you and us regarding the Site and Products.

Provisions relating to dispute resolution, limitation of liability, indemnification, warranty limitations, and intellectual property survive termination.
